These Terms govern your use of the Raindex app and the raindex.app website (the “Service”). By using the Service you agree to them.

1. Eligibility

You must be at least 13 years old (or 16 in the EU/EEA) to use the Service. By using it, you represent that you meet this requirement and can form a binding contract.

2. What Raindex is

Raindex shows estimated rainfall accumulation for locations you save: totals over 1, 3, 6, 12, 24, 48 and 72 hour windows, a daily history calendar, and optional threshold alerts. Rainfall data comes from NOAA MRMS (Multi-Radar Multi-Sensor), a public U.S. government precipitation product that combines weather-radar estimates with rain-gauge adjustment at roughly 1 km resolution. Forecast figures, where shown, come from the National Weather Service NDFD. Coverage is the United States only.

3. Measurement and safety disclaimer — please read

Raindex reports an estimate, not a measurement taken at your property, and it is not a flood-warning service.

Radar-derived rainfall is an estimate. It can differ from a physical rain gauge at the same spot because of terrain, the height of the radar beam over your property, variation in rainfall within a single kilometre, and the fact that gauges themselves under-catch in wind. We make no guarantee that any figure matches your gauge.
Figures are revised. The gauge-corrected pass runs roughly 97 minutes behind real time, so a recent total may change, upward or downward, as more data arrives.
Rainfall for frozen precipitation is reported as liquid equivalent and is materially less reliable than for rain.
The Service is not a substitute for official warnings from the National Weather Service, local authorities or emergency services. Never rely on Raindex alone for life-safety or flood-related decisions.
Delivery of alerts is not guaranteedand depends on factors outside our control (data feeds, network, your device, Apple’s push delivery).

You use Raindex at your own discretion and risk.

4. Subscriptions, billing and auto-renewal

Some features require a paid subscription, sold through Apple’s In-App Purchase. Payment is charged to your Apple Account at confirmation of purchase. Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours prior to the end of that period. Where a free trial is offered, any unused portion is forfeited when you purchase a subscription. You can manage and cancel subscriptions in your Apple Account settings.

5. License and acceptable use

We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service. You agree not to reverse-engineer it, scrape or bulk-extract its data, resell or redistribute the data as your own product, interfere with its operation, or use it in a way that violates applicable law.

6. Intellectual property

The Service, its design, and its original content are ours or our licensors’. Underlying U.S. government data is public domain and is not claimed by us.

7. Third-party data and services

Rainfall and forecast data are provided by NOAA (MRMS, NDFD, NCEI Climate Normals); maps are provided by Mapbox. Such third-party data and services are subject to their own terms and are provided without warranty. NOAA does not endorse this Service. We are not responsible for the accuracy, availability or content of third-party data.

8. Disclaimer of warranties

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure or error-free.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, crops, property, data or goodwill, arising out of your use of or inability to use the Service. Our total liability for any claim is limited to the amount you paid us in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold us harmless from any claim arising out of your use of the Service or your violation of these Terms.

11. Changes to the Service and Terms

We may modify or discontinue the Service, and may update these Terms. We will revise the “Last updated” date and, for material changes, provide reasonable notice. Continued use after changes means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of Portugal and applicable EU law, without regard to conflict-of-law rules, except where mandatory consumer-protection laws of your country of residence apply. Nothing in these Terms deprives you of the protection of those mandatory laws.

13. Apple-specific terms

These Terms are between you and Raindex only, not with Apple. Apple is not responsible for the Service or its content. To the extent there is any conflict between these Terms and Apple’s Licensed Application End User License Agreement for App Store apps, Apple’s standard EULA governs the license to use the app. You agree that:

Apple has no obligation to furnish maintenance or support for the app;
in the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); Apple has no other warranty obligation;
Apple is not responsible for addressing any claims relating to the app (including product liability, legal or regulatory compliance, or consumer-protection claims); and
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
